MAINE SUPREME JUDICIAL COURT RULES IN FAVOR OF STRONGER PUBLIC BEACH ACCESS RIGHTS

The Surfrider Foundation won an important victory on August 25 when the Maine Supreme Judicial Court unanimously ruled in William A. McGarvey Jr. et al. v. Steven R. Whittredge et al. that private ownership rights in the intertidal lands do not allow oceanfront property owners to exclude the public from crossing the wet sand to reach the ocean in order to SCUBA dive or run a SCUBA diving business.

SURFRIDER FOUNDATION APPEALS OCEAN DESALINATION TRIAL DECISION

The Surfrider Foundation filed appeal today of Superior Court Judge Judith F. Hayes’ ruling siding with the San Diego Regional Water Quality Control Board’s determination to allow “open ocean” intake to withdraw seawater for an ocean desalination facility on the Carlsbad coast, the largest ever planned in the United States, and the first to be scrutinized by the California courts. The issue will now go to the Court of Appeal in the 4th Appellate District, which covers San Diego.

The Surfrider Foundation won an important victory today when Judge Joan M. Lewis ruled in favor of open beach access at the Dana Point Strands Beach. Specifically, she ruled that the City of Dana Point’s severe beach access restrictions are unlawful because the record put forth by the City was “entirely lacking in evidentiary support for declaring a nuisance and that the City acted arbitrarily and capriciously in making such a declaration.”

Today marks the sobering anniversary of the massive Gulf Spill. On April 20, 2010, a blowout on British Petroleum’s Deepwater Horizon set off a chain of events that would eventually become our nation’s worst environmental disaster. The accident not only claimed 11 lives, but over the next 87 days, and estimated 4.9 million barrels of oil spilled out into Gulf, wiping out the livelihoods of tens of thousands of others.

SURFRIDER FOUNDATION ISSUES STATEMENT ON MARINE LIFE PROTECTION ACT

After several years of hard work and negotiations, the California Fish & Game Commission approved a network of 36 Marine Protected Areas (MPAs) in Southern California – part of a statewide process required by the 1999 Marine Life Protection Act (MLPA). The MLPA’s goals are to: ‘set aside’ areas of the ocean to increase fish populations, enhance marine habitat, and improve recreational and educational opportunities. Research on MPAs from around the world proves that they create larger fish populations and increase biodiversity within their boundaries.

SURFRIDER FOUNDATION NOTCHES 150 COASTAL VICTORIES

In 2005, the Surfrider Foundation set an ambitious goal to attain 150 coastal victories by the end of 2010. On December 1st, the organization successfully achieved this milestone when the Obama administration announced that it would ban new offshore drilling in the continental United States for the next seven years; capping a two-year effort by the Foundation to restore coastal protection lost in 2008.
