SURFRIDER FOUNDATION SETTLES LAWSUIT AND GAINS PUBLIC ACCESS AND BEACH PROTECTION IN PUERTO RICO

Settlement Will Help Minimize the Environmental Impact of the Sandy Beach Apartments while Calling Attention to Shortcomings of Permitting Process

Rincón, Puerto Rico (February 8, 2005) –The Surfrider Foundation and local citizens have reached an agreement with developer Wilfredo Vilá Suro that will minimize the impacts of the Sandy Beach Apartments on the local environment and will provide a permanent public beach access on the site. This agreement, which followed several court hearings, a preliminary injunction that halted work on the project for months, and extensive negotiations, will be enforced by the Aguada Courts to ensure all conditions are met.

The terms of the agreement emphasize minimizing the environmental impact of the project while providing for a permanent public beach access through the property that is clearly signed, maintained and open 24 hours a day.

As part of the accord, Vilá has agreed to hire a Surfrider Foundation approved coastal hazards specialist to study the site and to make recommendations on how to best minimize and mitigate any impacts to the beach systems, the nearby surf and water quality. The agreement further requires the developer to implement these recommendations while leaving the adjacent stream (quebrada) in its natural state.

Additionally, the developer has agreed to comply with all relevant laws and regulations when providing the mandated 18 parking spots while also reserving the area for the "Rincón Bicycle and Pedestrian Trail" on his property according to the existing DTOP plan.

"Given the legal tools available to us for a project at this late stage of construction, I believe this agreement will minimize the environmental impacts of this project and maximize the public’s benefit," says Miguel Sarriera Roman, Esq., attorney representing the Surfrider Foundation.

While the agreement successfully requires Mr. Vilá to make a considerable number of concessions to minimize and mitigate the impacts to the beach, it does not address the recurring problems of permits being granted in violation of applicable procedures while the community is denied its right to public participation.

"Although we feel this agreement represents the best practicable outcome for the community of Rincón, it still represents the failure of the Planning Board to provide the public its right to participation in the planning process," said Surfrider Rincón Coordinator, Leon Richter.

"The absence of a local zoning plan continues to result in land use decisions being made in San Juan with little or no public input. The Sandy Beach Apartments are a tragic symbol illustrating the need to establish a community-driven Plan de Ordenación Territorial that puts the control of Rincón’s future development in the hands of the local community."

La Fundación Surfrider Transa Demanda: Logra Acceso Público Permanente a la Playa y Protección Para la Zona Costera en Puerto Rico

Acuerdo Ayudará a Minimizar el Impacto Ambiental del proyecto Sandy Beach Apartments y pone en Evidencia las deficiencias en los Procedimientos de Permisos

Rincón, PR (8 de febrero, 2005) – La Fundación Surfrider y un grupo de Rincoeños han llegado a un acuerdo con el desarrollista Wilfredo Vilá Suro el cual ayudará a minimizar el impacto ambiental en el area del proyecto Sandy Beach Apartments y proveerá un acceso público permanente a la playa en el lugar. Este convenio, logrado tras varias vistas en el Tribunal, un interdicto preliminar deteniendo la construcción por meses y negociaciones extensas será implantado por el Tribunal de Distrito de Aguada para asegurar que todas las condiciones se cumplan.

Los terminos del acuerdo enfatizan en minimizar el impacto ambiental del proyecto al igual que proveer un acceso público permanente a la playa através de la propiedad el cual este adecuadamente identificado, mantenido y abierto 24 horas al día.

Como parte del arreglo, Vilá acordó contratar un especialista en erosión costera aprobado por la Fundación Surfrider para que estudie el lugar y haga recomendaciones en cuanto a como reducir y mitigar cualquier impacto al sistema playero, las olas cercanas y la calidad de agua. El acuerdo continúa requiriendo al desarrollista la implementación de estas recomendaciones mientras que la quebrada aledaña deberá permanecer en su estado natural.

Además, el desarrollador ha acordado cumplir con todas las leyes y reglamentos pertinentes al proveer los 18 estacionamientos exigidos por ley al igual que reservar un área en su propriedad para el "Paseo de Bicicletas" de acuerdo con el existente plan de DTOP.

"Dadas las alternativas legales disponibles en una esta etapa tardía en la construcción, entiendo que este acuerdo minimizará los impactos ambientales del proyecto y maximizará el beneficio público," dice el Lic. Miguel Sarriera Roman, abogado representando a la Fundación Surfrider.

Mientras que el acuerdo exitosamente require que el Sr. Vilá haga un número considerable de concesiones para minimizar y mitigar los impactos a la playa, no resuelve el problema recurrente de permisos otorgados en violación de los procedimientos aplicables, que pretenden garantizar el derecho de participación pública.

"Aunque este acuerdo representa la mejor posibilidad práctica para la comunidad de Rincón, todavía representa la falla de la Junta de Planificación en garantizar al público su derecho a participar en el proceso de planificación" dijo Leon Richter, coordinador de Surfrider Rincón.

"La ausencia de un Plan de Ordenación Territorial continúa causando que las decisiones de uso de terreno se hagan en San Juan con poca o ninguna participación del público. Sandy Beach Apartments es un trágico símbolo que ilustra la necesidad de establecer un Plan de Ordenación Territorial de iniciativa comunitaria que ponga el control del futuro desarrollo de Rincón en las manos de la comunidad local."
