Zoning Parameters & Requested/Approved Variantes
The actual zoning is RT-0 which allows for low density development subject to the following restrictions:
- Max. height 9 meters
- Max 1 living unit per 700 sq m
- Max build = 40%
Jennymar requested the following variances for its project located on slightly more than ½ acre:
- 4th floor with height of 10.36 m
- Density of 1 living unit per 147 sq m
- Build out = 98%
With these variances, the project actually meets with the standards for RT-4 zoning.
Consequently, ARPE (the permits office) has essentially granted a de-facto zoning change. However, ARPE does not have the jurisdiction to grant a zoning change (that jurisdiction belongs to the Planning Board). As such, this zoning change does not comply with PR law.
