May 5, 2006 - Appelate Court Rules in favor of Planning Board

Rincón, PR - The Appelate Court of Puerto Rico ruled against plaintiffs Guardaguas de Puerto Rico, Carlos Gastón, Edwin "Pauco" Font and the Commercial Fishing Association of Rincón. The plaintiffs filed the lawsuit alleging that the Planning Board had illegally granted a zoning change to allow for the construction of the Reina del Mar Condos.

In the lawsuit, the plaintiffs claimed that the Planning Board had not properly evaluated the environmental impact of the project. The 184 unit condo project is located near the Tres Palmas Marine Reserve.

The Commercial Fishing Association of Rincón, Mr. Gastón and Guardaguas have filed a Motion for Reconsideration to the Appelate Court.

5 de mayo del 2006- Tribunal Apelativo decide a favor de la Junta de Planificación

Rincón, PR - El Tribunal Apelativo de Puerto Rico falló contra los demandantes, Guardaguas de Puerto Rico, Carlos Gastón, Edwin "Pauco" Font y de la Asociación de Pescadores Comerciales de Rincón. Los demandantes presentaron su recurso alegando que la Junta aprobó el cambio de zonificación ilegalmente para hacer posible la construción de los condominios.

En el recurso, los demandantes también alegaron que la Junta no había evaluado correctamente el impacto al ambiente. El proyecto está a 200 metros de la Reserva marina Tres Palmas.
